THE State was yesterday accused of trying to legally ambush a Dublin businessman who is wanted in Hungary for mowing down two children.
Ciaran Tobin was convicted of negligent driving after killing a boy and his baby sister in Budapest in April 2000.
There was public outrage when the High Court refused to extradite him three years ago, but Hungarian authorities are taking a fresh challenge.
David Keane SC, for Mr Tobin, told the High Court yesterday that the behaviour of gardai and the State in arresting his client reminded him of secret laws used in Soviet Russia.
Mr Tobin, 46, was working for Irish Life in Budapest in April 9, 2000 when his Volvo S 40 crashed on Moricz Zsigmund Street in the village of Leanyfalu.
After overtaking at a speed of up to 80kph, he mounted the pavement and struck four-year-old Marton Zoltai and his sister Petra, aged two, who was in a pram. The children of Petra and Marton Zoltai were killed instantly.
Mr Tobin faces three years in jail if extradited under a new arrest warrant. His wife gripped his hand in court as his lawyers argued that his arrest last November was illegal.
At the time, the Criminal Justice (Miscellaneous Provisions) Act 2009 had been enacted on November 4 to amend the law on extradition. But when the senior manager with Irish Life was arrested for the second time six days later, the statute had not yet been made public, his barrister Mr Keane claimed Justice Minister Dermot Ahern, to breach Mr Tobin's rights to freedom and family life.
'The fact remains that this warrant was made pursuant to an Act that was not available to the public at the time. The minister very significantly and distinctly restricted the liberty of my client, using an unpublished statute. And in the circumstances, the warrant was not executed.' Mr Keane said the High Court judge who approved the warrant had no legal power to do so.
'Laws must be accessible - that is a preamble to the rule of law. There was no copy available at that stage and nobody but the minister had access to it. No one at the time had conception of the law but the minister, and the fundamental part of the Constitution in all countries is the rule of law.' In 2007, a request by the Hungarian authorities for Mr Tobin's extradition was refused.
The High Court found Mr Tobin's departure from Hungary could not be defined as 'fleeing'. It accepted Mr Tobin's argument that he and his family left Hungary on November 30, 2000, following the completion of work, and this was upheld in the Supreme Court in 2008.
Since then, there was a change to the law contained in the 2009 Criminal Justice Act.
A fresh European Arrest Warrant seeking Mr Tobin's arrest was issued by the Hungarian authorities.
But his legal team voiced concern that it differed greatly from the previous one that expressly stated he would be freed after 18 months.
Maurice Collins SC, for the State, told the judge that the Hungarian authorities had confirmed overnight that a parole board judge would have discretion to limit the term.
Mr Keane said the previous position adopted had misled the courts and that the ambiguity infringed Mr Tobin's right to family life.
Mr Justice Michael Peart has heard that Mr Tobin has been vilified in Hungary and has received a death threat.
Mr Tobin of Offington Drive, Sutton, Dublin, expressed concern for his safety that has been threatened.
In his affidavit, the High Court heard that he had tried to build a new life since the last court case.
The case continues today.

The Irish Court has, for the 12th time in the past year, "adjourned" reckless-driver-murderer Ciaran Tobin's extradition proceedings. The next hearing is scheduled for November 25-26.

Tavaly december óta immár tizenkét alkalommal napolták el az ügy tárgyalását. Az elmúlt hónapokban lezajlott rövid meghallgatások során szintén jórészt újabb megjelenési időpontok kitűzéséről és az adatok kiegészítésének elrendeléséről születtek döntések.

A baleset ír felelősét tavaly novemberben - a magyar hatóságok által kiadott európai elfogatóparancs alapján - Dublinban őrizetbe vették, de szabadlábon védekezhet. Ennek egyik feltétele, hogy a bíró által megszabott időpontokban meg kell jelennie a dublini felsőbíróságon, emellett hetente háromszor a lakhelye szerint illetékes rendőrkapitányságon is jelentkeznie kell.

Az ír szokásjoggal is szembemegy az, hogy immár 11. alkalommal napolta el kedden a dublini felsőbíróság Francis Ciarán Tobin, a Leányfalun két gyermeket halálra gázoló ír férfi kiadatási tárgyalását – mondta Bárd Petra, az Országos Kriminológiai Intézet osztályvezetője az MTI-nek.

Az MTI igazságügyi forrásokból úgy értesült, hogy az ügy kétnapos meghallgatáson október 28-a után folytatódik.

2009 decembere óta ez a 11. alkalom, hogy a tárgyalást elnapolják. Az elmúlt hónapokban lezajlott rövid meghallgatások során jórészt az eljárás halasztásáról és az adatok kiegészítésének elrendeléséről született döntés.

Bárd Petra elmondta, az ír szokásjog azt mutatja, hogy három-négy alkalommal halasztja el a bíró a tárgyalást, hogyha az egyik fél kéri. Ebben az esetben Tobin jogi képviselője kérte valamennyi alkalommal a tárgyalás elhalasztását.

Közölte azt is, hogy az európai elfogatóparancs azt mondja ki, hogy hatvan napon belül határozni kell az átadásról, ha valaki ahhoz nem járul hozzá. Ez további harminc nappal meghosszabbítható, de maximum kilencven naposra nyúlhat a határidő. Tehát a 2009. november 10-én őrizetbe vett Tobin esetében az átadásnak legkésőbb 2010 februárjáig meg kellett volna történnie – mutatott rá Bárd Petra. Hozzátette: a probléma az, hogy ennek a szabálynak nincsen semmiféle szankciója.

A jogász elmondta, hogy az Európai Unióban átlagosan 43 nap alatt történik meg az átadás. Bárd Petra szerint azért is meglepő, hogy ennyire elhúzódik az eljárás, mert az ír jogalkotó kifejezetten Tobin ügye miatt változtatott saját jogszabályán. Akkor a lépést sok szakértő fogadókészségként értékelte ír részről.

The High Court of Ireland has once again adjourned the extradition case of Francis Ciaran Tobin, an Irish man who ran over and killed two children while driving in Hungary in 2000.

Judicial sources told MTI in Dublin on Thursday that a two-day hearing is planned to take place after October 28. Since December 2009, this is the 11th time that the case has been adjourned.

Tobin, 43, a senior Irish Life insurance officer who represented his company in Hungary for three years, hit two children, aged two and five, when he swerved onto the pavement in his Volvo. The children died instantly.

In late 2000, when court proceedings got under way, the Hungarian court let him leave the country on bail. In October 2002, Tobin was sentenced to three years in prison in absentia. Following an appeal, the sentence was reduced to a year and a half. (This is an error in Caboodle's article. The sentence was NOT reduced, Tobin merely has the right to apply for parole after 18 months served. The Ed.)

Tobin, however, failed to return to Hungary to serve his prison term. Hungary formally asked for his extradition. The Irish Supreme Court rejected the request, arguing that Tobin had left Hungary legally before the sentence was passed.

An Irish law amendment, urged by Hungary's former justice minister Tibor Draskovics, made it possible for Irish authorities to take Tobin into custody, which they did in November last year. However, he has been freed on bail and must appear in the High Court for the hearings.

Case adjourned, again, till July 22

Mr. Justice Peart has adjourned, again, this time till July 22, the hearing of the case on Ciaran Tobin's exptradition in connection with his killing of two children in Hungary more than 10 years ago. Tobin is scheduled for a two-day hearing on that day, perhaps an indication that the judge will not tolerate further maneuvering by Tobin's lawyers and wants to finally bring the case to a close.

Case adjourned again, this time till the end of June. The European Arrest Warrant against Ciaran Tobin expires in 2012 (or so we know), so it's in Tobin's best - albeit costly - interest to drag on the case until then. 

The question is, will Mr. Justice Micheal Peart be party to Tobin's maneuvering? 

The current standing of this 10-year-old case continues to add, unfortunately, to the humiliation of Hungary and its justice system, and the ineffective institution of the European Arrest Warrant.

Note: MTI, the Hungarian News Agency, has now, at the request of Mr. Zoltai, correctly reported Tobin's sentence as "3 years in prison". (Previously both the Hungarian and Irish press stated, incorrectly and repeatedly, that "Ciaran Tobin's sentence was reduced to 18 months on appeal".) So again, for the press and everyone else:

Ciaran Tobin was sentenced, on appeal, to 3 years in prison by the Court of Hungary. He is entitled to apply for parole after 18 months served. (So that's where the "18 months" comes from.)

The High Court of Ireland has once again adjourned the extradition case of Francis Ciaran Tobin, an Irish man who ran over and killed two children while driving in Hungary in 2000.

At recent hearings, held every few weeks, the court repeatedly adjourned the case and requested further documents.

In late 2000, when court proceedings got under way, the Hungarian court let him leave the country on bail. In October 2002, Tobin was sentenced to three years in prison in absentia. A date will be set by the High Court next week for the hearing of fresh extradition proceedings, brought against an Irishman wanted in Hungary for causing the death of two children 10 years ago.

Hungarian authorities are seeking the surrender of Francis Ciaran Tobin (aged 46) of Offington Drive, Sutton, Dublin, who was convicted and jailed for 18 months in his absence, of negligent driving causing the deaths of Marton (aged five) and Petra (aged two) Zoltai in April 2000.

Today the High Court, Mr Justice Michael Peart presiding, heard the case was "ready" to have a date for its hearing fixed but that a short adjournment was being sought to allow for the "direct exchange" of legal submissions to take place.

Mr Ronan Kennedy SC, for the State, said there were more than 60 points of objection being raised on Mr Tobin’s behalf, some of which were of a constitutional nature, and that the hearing was likely to take two, perhaps three days.

The court was also told that a case heard by the Supreme Court earlier this week, related to an issue being canvassed in this case, and that it “might be helpful” to have the outcome of that decided before proceeding.

The judge said it was his desire to fix a date “urgently”, indicating his willingness to sit on a Saturday in an effort to alleviate scheduling difficulties on behalf of the legal teams involved.

The matter was adjourned until April 21 next when a date for the hearing will be fixed.

In 2007, a request by the Hungarian authorities for Mr Tobin's extradition was refused by the High Court. In its judgment it found Mr Tobin's departure from Hungary could not be defined as "fleeing", as had been contended on the extradition warrant.

The High Court said it accepted Mr Tobin's argument that he and his family left Hungary, on November 30, 2000, following the completion of his work and that he never fled Hungary.

That ruling was subsequently upheld by the Supreme Court in February of 2008.

Since then there was a change to the law contained in the 2009 Criminal Justice Act.

A fresh European Arrest Warrant seeking Mr Tobin's arrest was issued by the Hungarian authorities and it was endorsed by the High Court.

In the EAW it is claimed that Mr Tobin's car mounted a footpath in a built up area of Budapest on April 9, 2000.

As a result of the incident, Marton Zoltai, who was standing on the footpath, and Petra Zoltai, who was sitting in a pram at the time of the accident, were both killed.

It is claimed that Mr Tobin's wife and two Irish friends were in the car at the time of the fatal collision.

The following day, all four attended a police station, and made a statement with the assistance of a Hungarian lawyer. At the time of the crash he had been working for Irish Life in Budapest for three years.

Mr Tobin was sentenced to three years in prison by a Budapest Court, but this was reduced to 18 months on appeal.

Here we go again

The High Court of Ireland has, again, adjourned the extradition proceedings against Ciaran Tobin until mid-April, 2010.

The application for an adjournment was made by lawyers for Ciaran Tobin today as he appeared before the court.

Ciaran Tobin has been, for years, contesting his extradition to Hungary to do a jail term of 3 years in connection with the killing of Marci and Petra Zoltai (aged 4.5 and 1.5 at the time, in 2000), of Leányfalu, Hungary in a high-speed negligent driving incident.

Tobin will appear in court again next month.

24 March, 2010 - The Day of Justice?

On March 24, 2010, just a few days after St. Patrick's Day, Ciaran Tobin will, for the Nth time, appear before a judge of his native Ireland. We, at the Foundation, the people of Hungary, the family of Marci and Petra, no doubt all parents around the globe, and all others who have been appalled by Tobin's maneuvering to avoid justice over the years, strongly believe that on this day, March 24, 2010, Justice will prevail at last.

Almost 10 years to the day, April 9, 2000 when Tobin robbed our two children, Marci and Petra, of their lives.  Better late, than never, Your Honour.

Latest update on the extradition case of Ciaran Tobin: the case was adjourned for the second time yesterday. The next hearing will take place on February 3, 2010. According to press reports, the judge wants to 'see progress' at the next hearing, which may be an indication that further legal manoeuvring by Tobin's lawyers to delay his extradition is likely to be increasingly difficult.
