A sorozat megváltoztatta Victoriát, az országot és a statisztikákat. E reklámok hatásmechanizmusát ma tankönyvekben taglalják. Eredményességüket más - szelídebb - kampányokkal nem sikerült megismételni.

Meg kell mondani, az ausztráliai Victoria állam a közlekedési morál terén jobb helyzetben volt az kampány indulásakor, mint mi itt, ma. Mégis szükségesnek tartották.

De talán egy ilyen roham rajtunk is segíthetne. Más már nemigen fog, csak a megszabadító-ráébresztő sokk, hogy ami most van, az nem jó.

Mi meg itt egy nyamvadt postásbicikli-tendert se tudunk botrány nélkül levezényelni, se villamost rendeset venni, a metrónkat is egyik nap kifúrjuk, a másik nap betemetjük, elszórjuk az emberek pénzét, azt se tudjuk, mit akarunk, a gyerekeinkből is minden nap elütünk egyet, a lámpa három színét se tudjuk megkülönböztetni, nemhogy egy elszántságot, hitet és anyagi elkötelezettséget kívánó országos kampányt felvállaljunk.

Gázt nyomni, írt futni hagyni. Ehhez értünk.

Where we are at now

On April 9, 2000, Irish banker and guest-worker-in-Hungary Ciaran Tobin drove on the sidewalk some 70 meters. He ran over and killed two children, Marci Zoltai (4) and Petra Zoltai (2), who were waiting with their grandmother and aunt to cross the street at a pedestrian crossing in the village of Leányfalu, outside of Budapest, Hungary.

Both children died on the scene.

What happened after is a mockery of the Hungarian judicial system. Helped by a thick pocket and a star-studded defense lawyer team, Ciaran Tobin made his way out of the country before the trial, never to return. He was sentenced, in his absence, to 3 years in prison by the Buda District Court in 2002.

Hungary issued a European Arrest Warrant for Ciaran Tobin in 2005 and a "surrender (a.k.a. extradition) request" to Ireland. The Irish Court turned down Hungary's request to surrender Tobin and also refused to carry out the sentence on Irish soil referring to the meaning of the English verb "flee". Whatever.

It has been more than 8 years since the crime. Ciaran Tobin never spent one minute in jail for robbing Marci and Petra Zoltai of their lives.

Ciaran Tobin has lived near Dublin, Ireland, undisturbed, working as a senior manager of a large insurance company that has the words "Irish" and "life" in its name. For us, since April 9, 2000, those words translate to "Hungarian" and "death".

As a new development in the case, a document has been recently uncovered that Ciaran Tobin allegedly signed in Hungary in 2006, which may change the whole legal ballgame. In light of this new fact, Hungary is now reportedly about to issue a new EAW.

It's not over, Ms. Tobin

Summary in English: contrary to what Ms. Tobin said to TV2's reporter, Gergely Papp at the door ("don't disturb us, there are children in the house, we're having dinner, it was an accident, and it's over") it's NOT over. ZöPö maintains it will be over when justice is served, when crime is followed by punishment. He then adds, somewhat dryly: "it is advised that you plan family events accordingly. Thank you." Annak már vége van

Tavaszi vasárnap volt, édesanyámmal Törökbálinton voltam nagybevásárolni. Hazaérve épp csak ledobtuk az előszobában a szatyrokat, kicsit kifújni készültünk magunkat, én a bekapcsolt számítógépnél az Index Fórumot olvasgattam (most figyelj, micsoda szinkronicitás: ezt a topicot), amikor megcsörrent a telefon. Lusta voltam felállni, hagytam, hogy édesanyám vegye fel a másik szobában. Aztán már csak arra figyeltem fel, hogy anyám sikít, nem, Bence, nem, nem. Istenem, bocsásd meg nekem, először őrá lettem mérges, nyilván öcsém megint előadott neki valami program-ötletet, gondoltam, nem szoktál te így hisztériázni, szóltam rá majdnem, de addigra letette a telefont és színtelen hangon közölte: Marci és Petra meghalt, mert Leányfalun egy autó felment a járdára. Így mondta: felment, akkor még részleteket nem tudtunk. Akkor besűrűsödött a levegő körülöttem, onnantól kezdve hónapokig olyan volt, mintha vajban kellene utat törnöm minden nap, futni azóta sem tudok egy méternél többet.

Azonnal visszaültünk az autóba és indultunk Leányfalura. Olyan süket csendben nem autóztam még, éjszaka, egyedül sem. Csak arra emlékszem, hogy a sávot igyekeztem tartani, nem hiszem, hogy az előttem lévő tíz-tizenöt méteren kívül bármit is láttam volna. Végül megérkeztünk. Láttam a szörnyeteg Volvót, a végighasított oldalú sárga buszt, a kiszakított kresz-táblákat, a döbbenettől bénultan álló szomszédokat-ismerősöket. Láttam a villanyoszlop és a kőpárkány közé gyűrt babakocsit, amiben egy órával előtte még egy emberi lény, egy csupa derű másfél éves kislány ült. Láttam a földön a vértócsát, olyan kis picike volt, nem is feltűnő, egy négy éves kisfiú semmi kis vére. Istenem, miért ők, miért nem inkább én, aki ezt százszor vagy ezerszer megérdemeltem, ők soha, egyszer sem...

Anyám elkezdte összeszedni a földről a babaruhákat, a mentősök vették le őket a gyerekekről, amikor újraéleszteni próbálták őket. Egy egész Vészhelyzet epizód nem lenne elég, olyan sokáig küzdöttek a gyerekekért, mert az emberi agy már csak ilyen: képtelen feladni, noha tudja, hogy késő, késő volt már akkor is, amikor a Volvo még mozgásban volt, vége volt akkor már mindennek.

Nem sírtam se ott, se a temetésen, ahol ott volt egész Leányfalu, még évekig nem. Végül egy csokimikulás váltott meg. Edinától kaptam mindig december elején, én pedig, nem lévén csokievő, feltettem őket sorban a polcra. Aztán egyszer festették a lakásomat, mindent áthordtam anyámékhoz. Öcsém jött vendégségbe Marcival. Látom ám, hogy a kisfiú nagyon bújik az ágy mögé. Előhúztam, mit csinálsz, kis ember, hát látom, hogy valahogy megkaparintotta a több éve a polcomon porosodó csokimikulást és azt majszolja. Csak nevettem rajta, soha nem bocsájtanám meg magamnak, ha akkor megharagudtam volna érte. Egy vagy két évvel a baleset után kaptam megint egy kis figurát Edinától, akkor hirtelen gombóc nőtt a torkomban, még volt időm félrehúzódni, aztán már csak a könnyeim folytak, megállíthatatlanul.

Tegnap Papp Gergő jóvoltából újra láthattam azt a nőt, akit akkor láttam Leányfalun: akkor a kőpárkányon ülve egy láthatóan sokkos állapotban sírdogáló kisfiút próbált vigasztalni. Tobinné őnagysága most magából kikelve zavarta el Gergőt a kapuból, mit képzel, éppen vacsorázunk, itt van az egész család. És különben is, annak a történetnek vége, érti, vége.

Hát nem, drága Tobinné, nincs vége. Önöknek nincs, nem lehet. Számunkra igen, a kedves férje jóvoltából vége volt mindennek 2000 április 9-én, de nem az Önök számára. Tessék csak figyelni: bűn, majd nyomozás, tárgyalás, ítélet és végül bűnhődés. A Tobin család számára így és csak így lehet vége a történetnek. Tessék szépen tudomásul venni és a családi programokat ehhez igazítani. Köszönöm.

Irishman who ran down children ‘did not flee’ Hungary

A senior life insurance manager who ran down and killed two children in Budapest cannot be extradited because he did not ‘flee’ from Hungary, the Supreme Court has ruled.

Ciaran Tobin, an accountant with an address at Cairn Manor, Ratoath, Co Meath, was working with Irish Life in Budapest in April 2000 when his car mounted a footpath and hit Marton Zoltai and his sister Petra, aged 5 and 2, killing both children. The three passengers in the car included Tobin’s wife.

In August 2000,Tobin, a 43-year-old father of two, asked the Hungarian authorities for permission to return to Ireland with his family. He said his wife had been asked to be a bridesmaid at her sister’s wedding and he wanted his elderly parents to meet his children, as they could not easily travel to Hungary.

Tobin returned to Hungary in October 2000, but left the country permanently the following month, when his job there finished. Criminal proceedings began in Hungary in September 2000 and Tobin was charged with negligently causing a fatal traffic accident.

He wrote to the Hungarian authorities saying he accepted the seriousness of what had happened and was "committed to the process of bringing a resolution to this tragedy", but he did not attend his trial in May 2002. He was convicted and sentenced to three years’ imprisonment, fined and banned from driving.

In October 2005,Pest county court in Budapest issued a European arrest warrant seeking Tobin’s extradition to serve the sentence. However, in the High Court in January 2007, Mr Justice Michael Peart refused the extradition application. He said Tobin’s departure from Hungary could not be defined as ‘‘fleeing’’ under the terms of the 2003 European Arrest Warrant Act.

Peart said: "The fleeing must occur following the imposition of sentence, and not, as in this case, where the respondent left before his trial.

In my view, the plain and ordinary meaning of ‘fled’ cannot be regarded as the same as the plain and ordinary meaning of ‘left’. The former has within it an intention to escape from or to evade something, such as, in this case, justice." The Minister for Justice appealed against the decision.

Counsel for the minister said the word "flee" was capable of a number of different meanings and did not exclude a person who left a country in the way in which Tobin left Hungary. It could apply to a person who left or went away from the member state which issued the warrant, thus evading the sentence imposed on him.

On February 25, the Supreme Court gave its reasons for rejecting the appeal. Mr Justice Fennelly, on behalf of the five-judge court, said that Tobin had left Hungary "lawfully and regularly", and that his trial had gone ahead in his "voluntary and duly authorised absence".

"It should be said that the judgment of the Hungarian court, insofar as it is available, is detailed and meticulous,” said Fennelly. But he said the Irish courts were not required to set aside or rewrite national laws in order to conform to the 2002 Council Framework decision on the European arrest warrant.

If the Supreme Court were to order the extradition of Tobin, it would have to be satisfied that he fell within the provisions of the Irish legislation.

"I am satisfied that he did not flee. If the court were to hold otherwise, itwould be acting contrary to the clear meaning of the act of 2003,” said Fennelly.’ ‘It follows that his surrender cannot be ordered. For these reasons, the appeal should be dismissed."

"Every day I think about my little boy and my little girl, what would they be doing now. Easter, Christmas and birthdays are the worst. They would have been 10 and 12. All the things we would have done together have been taken from us.

A Torontóval egybenőtt Mississauga önkormányzata, ahogy a címre kattintással is olvasható, számos megoldást dolgozott ki a biztonságosabb közlekedés és konkrétan a gyalogosok biztonsága érdekében. Ezek közül az egyik a "red light camera": pirosra váltástól a következő zöldig a lámpa (vagy a beépített webkamera) felvételt készít minden áthaladóról. A piroson áthaladók automatikusan 190 dolláros büntetést kapnak postán (ami pontlevonással és a kötelezőbiztosítási-díjuk drasztikus megnövekedésével is jár). Egyébként se megy át senki, de így meg pláne nem: a megúszás esélye nulla, a szankció - anyagilag is - drasztikus.
Rendőr élőerő sem kell hozzá. A rendszer elegánsan egyszerű, fair, automatizált, hatékony, és - ami ott nemigen, itt viszont nagyonis szempont - megvesztegethetetlen. Működik.
Az eszköz javasolt első magyarországi telepítési helyszíne: Leányfalu, az Erkel és Móricz Zs. utcák kereszteződése. Második helyszín Pécsen, aztán Bonyhád, aztán az ország összes iskolája melletti zebra (már ahol van).
Ahogy a dolgok mennek itt mostanában, egypár gyermekkel minden héten többen lennénk.
