Let's get this right, for the nth time: Ciaran Tobin was sentenced to 3 years in prison. He's eligible to apply for parole after 18 months. Which means, the sentence was NOT reduced on appeal. Ani, next time, get it right, please. :)

Közlemény
Az RTL bepanaszolta a Justice for Marci and Petra Foundationt, hogy jogosulatlanul tett fel a youtube-ra videókat (részletek itt: www.ciaran-tobin.com). Ez technikailag nyilván így van - bár évekig ez nem zavarta őket. Mindazonáltal tisztelettel kérjük a Magyar RTL-t, vonja vissza követelését. Indokaink a következők:
- a videók youtube-ra való feltöltéséből anyagi hasznunk nincs
- a videók sok már helyen elérhetők, mi csak egy helyre gyüjtöttük őket
- a videók nemzetközi közönség előtt történő közzététele kiemelten fontos társadalmi ügyet szolgál Magyarországon:
- két magyar kisgyermek élete előtt tisztelgünk
- a magyar igazságszolgáltatás tekintélyének helyreállításáért küzdünk
- az alapvető emberi igazságérzetünk és morális felelősségérzetünk szerint cselekszünk
Minden emberi közösség megkerülhetetlen alapértéke a Jog. Célunk semmi más, mint hogy a Magyar Bíróság jogerős ítéletének érvényt szerezzünk.
Ez a jog igazi védelme. Tessék ebben nekünk segíteni, ne pedig keresztbe tenni.

Ciaran Tobin's extradition case adjourned - again, and again, and again
The question is, will Mr. Justice Micheal Peart be party to Tobin's maneuvering?
The current standing of this 10-year-old case continues to add, unfortunately, to the humiliation of Hungary and its justice system, and the ineffective institution of the European Arrest Warrant.
Also for the record: today's news, as reported by Radio Kossuth.
"Tovább húzódik a leányfalui ír gázoló kiadatása. A dublini felsőbíróság Június végéig elnapolta a férfi kiadatási tárgyalását. Francis Ciaran Tobin tíz évvel ezelőtt autójával előzés közben egy öt és egy kétéves kisgyermek halálát okozta. A szerencsétlenség után nem sokkal hazament Írországba, távollétében a magyar bíróság háromévi börtönre ítélte. Tavaly – az európai elfogatóparancs alapján – Dublinban őrizetbe vették, de szabadlábon védekezhet."
Note: MTI, the Hungarian News Agency, has now, at the request of Mr. Zoltai, correctly reported Tobin's sentence as "3 years in prison". (Previously both the Hungarian and Irish press stated, incorrectly and repeatedly, that "Ciaran Tobin's sentence was reduced to 18 months on appeal".) So again, for the press and everyone else:
Ciaran Tobin was sentenced, on appeal, to 3 years in prison by the Court of Hungary. He is entitled to apply for parole after 18 months served. (So that's where the "18 months" comes from.)

The High Court of Ireland has once again adjourned the extradition case of Francis Ciaran Tobin, an Irish man who ran over and killed two children while driving in Hungary in 2000.
Judicial sources told MTI in Dublin on Thursday that Tobin will have to appear in court next on April 21.
At recent hearings, held every few weeks, the court repeatedly adjourned the case and requested further documents.
Tobin, 43, a senior Irish Life insurance officer who represented his company in Hungary for three years, hit two children, aged two and five, when he swerved onto the pavement in his Volvo. The children died instantly.
In late 2000, when court proceedings got under way, the Hungarian court let him leave the country on bail. In October 2002, Tobin was sentenced to three years in prison in absentia. Following an appeal, the sentence was reduced to one and a half years. [THIS IS INCORRECT. TOBIN WAS SENTENCED TO THREE YEARS ON APPEAL. ED.]
Tobin, however, failed to return to Hungary to serve his prison term. Hungary formally asked for his extradition. The Irish Supreme Court rejected the request, arguing that Tobin left Hungary legally before the sentence was passed.
A recent Irish law amendment, urged by Hungary's former justice minister Tibor Draskovics, has made it possible for Irish authorities to take Tobin into custody, which they did in November last year. However, he has been freed on bail and must appear in the High Court for the hearings.

A date will be set by the High Court next week for the hearing of fresh extradition proceedings, brought against an Irishman wanted in Hungary for causing the death of two children 10 years ago.
Hungarian authorities are seeking the surrender of Francis Ciaran Tobin (aged 46) of Offington Drive, Sutton, Dublin, who was convicted and jailed for 18 months in his absence, of negligent driving causing the deaths of Marton (aged five) and Petra (aged two) Zoltai in April 2000.
Today the High Court, Mr Justice Michael Peart presiding, heard the case was "ready" to have a date for its hearing fixed but that a short adjournment was being sought to allow for the "direct exchange" of legal submissions to take place.
Mr Ronan Kennedy SC, for the State, said there were more than 60 points of objection being raised on Mr Tobin’s behalf, some of which were of a constitutional nature, and that the hearing was likely to take two, perhaps three days.
The court was also told that a case heard by the Supreme Court earlier this week, related to an issue being canvassed in this case, and that it “might be helpful” to have the outcome of that decided before proceeding.
The judge said it was his desire to fix a date “urgently”, indicating his willingness to sit on a Saturday in an effort to alleviate scheduling difficulties on behalf of the legal teams involved.
The matter was adjourned until April 21 next when a date for the hearing will be fixed.
In 2007, a request by the Hungarian authorities for Mr Tobin's extradition was refused by the High Court. In its judgment it found Mr Tobin's departure from Hungary could not be defined as "fleeing", as had been contended on the extradition warrant.
The High Court said it accepted Mr Tobin's argument that he and his family left Hungary, on November 30, 2000, following the completion of his work and that he never fled Hungary.
That ruling was subsequently upheld by the Supreme Court in February of 2008.
Since then there was a change to the law contained in the 2009 Criminal Justice Act.
A fresh European Arrest Warrant seeking Mr Tobin's arrest was issued by the Hungarian authorities and it was endorsed by the High Court.
In the EAW it is claimed that Mr Tobin's car mounted a footpath in a built up area of Budapest on April 9, 2000.
As a result of the incident, Marton Zoltai, who was standing on the footpath, and Petra Zoltai, who was sitting in a pram at the time of the accident, were both killed.
It is claimed that Mr Tobin's wife and two Irish friends were in the car at the time of the fatal collision.
The following day, all four attended a police station, and made a statement with the assistance of a Hungarian lawyer. At the time of the crash he had been working for Irish Life in Budapest for three years.
Mr Tobin was sentenced to three years in prison by a Budapest Court, but this was reduced to 18 months on appeal.

Sokadszorra is elnapolták a leányfalui ír gázoló, Francis Ciarán Tobin kiadatási perét. Az ír bíróság az elmúlt hónapokban adatok bekérésére vagy más okokra hivatkozva többször is elnapolta a pert. A két magyar kisgyereket tíz évvel ezelőtt halálra gázoló ír férfi szabadlábon maradhatott az eljárás idejére.
A jövő hétig ismét elnapolta a dublini felsőbíróság Francis Ciarán Tobinnak, a két kisgyermek halálát okozó, egy évtizeddel ezelőtti leányfalui gázolás ír felelősének kiadatási tárgyalását. Az MTI dublini igazságügyi forrásainak csütörtöki beszámolója szerint Tobinnak legközelebb április 21-én kell megjelennie a bíró előtt. Az eddigi, néhány hetente lezajlott rövid bírósági tárgyalások során szinte mindig csak az eljárás elnapolásáról és adatkiegészítés elrendeléséről döntött az ír bíróság.
Tobin, az Irish Life biztosítótársaság megbízásából három évig dolgozott a cég képviseletében Magyarországon. 2000. április 9-én, Leányfalun Volvójával előzés közben felhajtott a járdára, és elütött egy öt éves kisfiút, és két éves testvérét, mindketten a helyszínen meghaltak. Tobint - aki 2000. november 30-án, kiküldetése lejártával távozott Magyarországról - 2002-ben, távollétében az eljáró magyar bíróság háromévi szabadságvesztésre ítélte; ezt fellebbezés után 18 hónapra csökkentették.
Az ír férfit tavaly novemberben - a magyar hatóságok által ismételten kiadott európai elfogatóparancs alapján - Dublinban őrizetbe vették, de szabadlábon védekezhet. Ennek egyik feltétele, hogy a bíró által megszabott időpontokban meg kell jelennie a dublini felsőbíróságon, emellett hetente háromszor a lakhelye szerint illetékes rendőrkapitányságon is.
